Exporting and Re-exporting WinMagic's Encryption Products

Many products, software and technologies are subject to export control for both Canada and the United Sates of America. WinMagic advises all customers that they are responsible for familiarizing themselves with these regulations. Exports and re-exports of WinMagic Inc. products are subject to Canadian and US export controls administered by the Canadian Border Services Agency (CBSA) and the Commerce Department’s Bureau of Industry and Security (BIS).

The information provided by CBSA and BIS can help customers determine whether they need to apply for an export license. Under an agreement with the United States, the Government of Canada gets export information on goods destined for consumption in the United States market directly from United States import data.

WinMagic products are eligible for export to any end user (including government end users) in all countries except the Embargoed Countries/Area Controlled List Countries: Afghanistan, Angola, Belarus, Cuba, Democratic People's Republic of Korea [North Korea], Eritrea, Federal Republic of Yugoslavia [Serbia and Montenegro], Iran, Iraq, Liberia, Libya, Myanmar [Burma], Rwanda, Sierra Leone, Syria, and Sudan.

For restricted goods to the United States, you must provide the CBSA with the required export permit as well as any other documents required by government departments or agencies that regulate the export of these goods. In the case of restricted goods covered under General Export Permits (GEPs), you may not be required to submit individual export permit applications to International Trade Canada (ITCan) but you should contact ITCan to find out how to report those goods.  Also, an export license may be required for shipping documentation, recordkeeping, or post-shipment reporting.

WinMagic’s encryption products may not be exported or re-exported, either directly or indirectly, to any country embargoed by the U.S. and Canada (Afghanistan, Angola, Belarus, Cuba, Democratic People's Republic of Korea [North Korea], Eritrea, Federal Republic of Yugoslavia [Serbia and Montenegro], Iran, Iraq, Liberia, Libya, Myanmar [Burma], Rwanda, Sierra Leone, Syria, and Sudan.) without prior authorization from the EAR/CBSA and other applicable U.S./Canadian government agencies.

WinMagic is providing this information as a general guideline to its customers. CBSA and BIS requires that each entity exporting products be familiar with any appropriate export regulations. Please note that the government export regulations are subject to change. WinMagic recommends that customers obtain their own legal advice when attempting to export. In addition some countries may restrict certain levels of encryption imported into their country. WinMagic recommends consulting legal counsel in the appropriate country or the applicable governmental agencies in the particular country.
